These Terms of Service apply to purchases from and use of the MotionBar online store and related services. MotionBar is located at Kanaalkade 157, 4571 CH Axel, Netherlands. You can contact us at motionbarthebrand@outlook.com.
1. Applicability and consumer rights
By using our store or placing an order, you agree to these Terms to the extent permitted by applicable law.
Nothing in these Terms limits or excludes mandatory consumer rights. If a mandatory consumer law conflicts with these Terms, the mandatory law applies.
2. Products and product information
We aim to describe and display our products accurately. Colours and appearance may vary slightly depending on your screen, production process or reasonable manufacturing differences.
Product availability may change. We may correct obvious errors in product information or pricing where permitted by law.
3. Prices and charges
The price applicable to your order is shown before you complete checkout.
Applicable taxes, shipping charges and other costs will be displayed or communicated where required before purchase.
For international orders, local import duties or taxes may apply where these are not collected at checkout.
4. Orders
Placing an order is an offer to purchase the selected products.
We may refuse or cancel an order where there is a lawful reason, for example if a product is unavailable, payment cannot be authorised, an obvious pricing error occurred or fraud is reasonably suspected.
If we cannot accept an order after payment has been taken, we will refund the relevant amount.
5. Payment
You must provide accurate billing and payment information and be authorised to use your selected payment method.
Third-party payment providers may process payments and their own terms may also apply to their payment services.
6. Delivery
Delivery times shown in our store are estimates unless we expressly agree otherwise.
We will deliver orders in accordance with applicable consumer law.
For consumer purchases, the risk of loss or damage generally remains with MotionBar until you, or a person designated by you other than the carrier, physically receives the goods, subject to applicable law.
7. Withdrawal, returns and refunds
Consumers may have a statutory right to withdraw from an online purchase.
Details about returns, return costs, refunds and exceptions are provided in our Refund Policy.
Your statutory consumer rights remain unaffected.
8. Legal guarantee and defective products
Products must meet the agreement and the standards a consumer may reasonably expect.
If a product is defective, damaged, not as described or otherwise non-conforming, you may be entitled to repair, replacement, a price reduction, refund or another remedy depending on applicable law.
Any additional commercial warranty does not replace your statutory rights. Dutch consumer rules require sellers to provide a solution when goods do not conform to what the consumer may reasonably expect.
9. Promotions and discount codes
Promotions, discount codes and rewards may have additional conditions shown with the relevant offer.
Unless otherwise stated or required by law, discounts cannot be applied retrospectively to completed orders.
10. Intellectual property
The MotionBar name, logos, graphics, photographs, product designs, written content and other protected store content are owned by MotionBar or used under licence.
You may not reproduce, distribute or commercially exploit protected store content without permission, except where applicable law permits it.
11. Acceptable use
You must not use the store for unlawful purposes, interfere with its security or operation, introduce malicious code, misuse another person's information or infringe the rights of MotionBar or third parties.
12. Third-party services
Our store may use third-party services for areas such as ecommerce, payments, fulfilment and analytics.
Where you use a third-party service, that provider's own terms and privacy information may also apply.
13. Privacy
Our handling of personal information is described in our Privacy Policy.
Shopify and other service providers may also process personal information where necessary to provide their services.
14. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful or restricts mandatory consumer rights.
Any limitation of liability in consumer terms must remain reasonable; Dutch consumer rules do not allow businesses simply to exclude liability through unfair standard terms.
15. Events outside our control
We are not responsible for delays caused by circumstances genuinely outside our reasonable control, but this does not affect mandatory rights relating to delivery, cancellation or refunds.
16. Changes to these Terms
We may update these Terms from time to time.
For a purchase, the version in force when the order was placed generally applies unless applicable law requires otherwise.
17. Governing law and disputes
These Terms are governed by Dutch law.
If you are a consumer living in another country, this does not remove any mandatory consumer protection that applies to you under applicable law.
Disputes will be handled by the competent court determined under applicable law.
